Welcome to Ớt Gà Đen. This website is operated by Vietnam Legacy Foods, LLC. By visiting our site or purchasing from us, you agree to these terms. If you don't agree, please don't use the site.
1. Our products
We make small-batch food products. Because they're handmade, small variations between batches in color, texture, and heat are normal — that's the nature of the thing, not a defect. Product images are representative; your jar may differ slightly. All products are perishable once opened and must be refrigerated after opening, as stated on the label.
2. Orders
We reserve the right to refuse or cancel any order — for example, if a product is listed at an incorrect price, is out of stock, or we suspect fraud. If we cancel your order after you've been charged, we'll refund you in full. We may limit quantities per customer, per household, or per order.
3. Pricing and availability
Prices and availability are subject to change without notice. Because we produce in small batches, products sell out; we don't guarantee availability of any product at any time.
4. Payment
Payment is due at the time of purchase through the payment methods offered at checkout. By providing a payment method, you confirm you're authorized to use it.
5. Shipping, refunds, and subscriptions
Shipping, returns, refunds, and subscription cancellations are governed by our Shipping Policy, Refund Policy, and Purchase Options Cancellation Policy, which are part of these terms.
6. Allergies and food safety
Ingredient lists are printed on every jar and shown on each product page. Please read them before consuming. If you have food allergies or dietary restrictions, review the ingredients carefully and contact us at hello@otgaden.com with any questions before ordering. Consume at your own discretion — our products are genuinely spicy.
7. Accuracy of information
We work to keep information on this site accurate, but occasional errors happen (typos, pricing mistakes, outdated details). We reserve the right to correct errors and update information at any time without prior notice.
8. Intellectual property
Everything on this site — the Ớt Gà Đen name, the black rooster mark, our story, photos, label designs, and site content — belongs to Vietnam Legacy Foods, LLC. You may not copy, reproduce, or use it commercially without our written permission.
9. Your conduct
You agree not to use this site for anything unlawful, to attempt to interfere with its operation, or to misrepresent your identity when ordering.
10. Disclaimer and limitation of liability
This site and our products are provided "as is." To the fullest extent permitted by law, Vietnam Legacy Foods, LLC is not liable for indirect, incidental, or consequential damages arising from your use of the site or products. Our total liability for any claim is limited to the amount you paid for the product giving rise to the claim. Nothing in these terms limits rights you have under applicable law that cannot be waived.
11. Governing law
These terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

We may update these terms from time to time by posting the revised version here. Your continued use of the site after changes are posted means you accept them.
